Halle Berry's Co-Parenting Plan Dispute: Court Denies Urgent Request

Halle Berry's bid to have a court intervene in her co-parenting agreement with ex-husband Olivier Martinez has been denied. The actress had alleged that Martinez had not been participating in co-parenting therapy as previously agreed.

In May, the former couple had agreed to "co-parenting therapy" with a coach to help resolve disputes and conflicts in their shared parenting of their nine-year-old son Maceo. However, Berry claimed that Martinez unilaterally ended the sessions without notifying her or the therapist.

Berry alleged in a recent court filing that Martinez had repeatedly violated agreements and court orders, harming their son and straining their already strained relationship. She sought an order for Martinez to attend at least one more session before the end of July and continue with the agreed schedule in August.

Despite Berry's request, Judge Shelley Kaufman denied the intervention, citing a "lack of exigent circumstances". This means that the judge did not consider the situation an urgent, emergency matter.

Berry argued in her filing that despite the agreement, no joint sessions had been scheduled and no third parties, like Maceo's school or therapists, had been contacted. She further claimed that Martinez had taken "the summer off" and pushed back co-parenting therapy until September, citing trips to France and a visit from his brother.

While the sessions were conducted via Zoom, negating the need for physical presence, Berry accused Martinez of refusing to complete necessary paperwork to allow the therapist to speak with relevant third parties. She alleged that Martinez's suggestion of co-parenting therapy was a tactic to "delay intervention at all costs" and interfere with her relationship with their son.

Ultimately, Berry accused Martinez of disrupting the "entire therapeutic process".

Despite seeking intervention from the court, Berry claims she had tried to resolve the matter personally and through their attorneys before resorting to legal action.

Berry and Martinez finalised their divorce last August. The agreement granted them shared legal custody of Maceo, with Berry paying Martinez £6,400 a month in child support and an additional 4.3% of her income exceeding £1,600,000.

The couple first filed for divorce in October 2015 after two years of marriage.

“It is with a heavy heart that we have come to the decision to divorce,” the couple stated at the time. “We move forward with love and respect for one another and the shared focus of what is best for our son. We wish each other nothing but happiness in life and we hope that you respect our and, most importantly, our children’s privacy as we go through this difficult period.”
